1. Introduction
These E-Commerce Terms and Conditions (Terms) explain how we supply our products to you through our website clawandcaneprints.com.au (the Site). By placing an order, you agree to these Terms along with our Privacy Policy and Website Terms of Use.
Nothing in these Terms limits your rights under the Australian Consumer Law (ACL).
2. Our Products (Made-to-Order Photographic Prints)
2.1 Nature of our products
All of our products are original photographic prints created by us. They are available in three standard sizes, A2, A3 and A4, and can be purchased either unframed or professionally framed in black or white. Every product we sell, whether framed or unframed, is made to order and produced specifically for you once your order has been confirmed.
2.2 Print quality and materials
We use a giclée printing process with genuine Epson Ultrachrome archival links to ensure fine detail and long-lasting colour vibrancy. Prints are produced on 230gsm premium white photo matte paper, chosen for its professional finish and durability.
For framed prints, we have chosen solid timber frames in black or white with a smooth gesso coating. The timber is FSC-certified as sustainably sourced. Instead of glass, frames are finished with high-grade acrylic (plexiglass). Canvas printing is available on request and is more expensive to ship. Please email: contact@clawandcaneprints.com.au
2.3 Production and fulfilment
Framing and dispatch are managed by our trusted production partner, Frames Now, who prepare, package, and ship framed works directly to customers in plain, protective packaging. Production usually takes 4–5 business days, although this may extend during peak periods such as Christmas or Father’s Day. The choice of carrier is determined by our production partner and may vary depending on the destination.
3. Prices and Taxes
All prices on the Site are displayed in Australian Dollars (AUD). Prices may change from time to time but the price shown at checkout is the price payable for your order. Any applicable GST and shipping charges will be added and shown before payment is finalised.
4. Order
4.1 Placing an Order
To place an order, select your chosen image, size and (if applicable) frame colour, then add the item to your cart and proceed to checkout. You may complete your purchase either as a guest or by creating an account.
The order becomes binding once full payment has been made, at which point we will send you an order confirmation by email.
4.2 Our right to decline an order
We may refuse or cancel an order (and provide you with a full refund) if, for example:
· there is an error in pricing or product information;
· fraudulent or unauthorised activity is suspected; or
· production is not reasonably possible.
4.3 Changing or cancelling an order
Because all products are made to order and production begins very quickly:
· you may only request a change or cancellation if you contact us immediately after purchase and before production has commenced;
· once production has commenced, your order cannot be changed or cancelled; and
· in all cases, the final decision on whether a change or cancellation can be accommodated rests with us.
5. Payment and Security
We accept credit card, PayPal, and Afterpay which is processed securely through Shopify’s payment gateways. By submitting your details, you authorise the payment provider to debit your account.
For your protection, we do not store or see your full card details. Payment security and processing are handled directly by the third-party provider under their own terms and privacy policies.
6. Production and Timeframes
Our standard production time is approximately 4–5 business days. This period covers the processing of your order, printing of the selected image, and (where applicable) framing and packaging.
Please note that this timeframe is provided as an estimate only. Actual production and delivery times may vary due to a range of factors outside our control, including delays by our trusted third-party production partner (currently Frames Now) or shipping carriers.
During busy seasons (such as Christmas, Father’s Day, Mother’s Day or other peak periods), both production and delivery may take longer than usual. Once your order has been produced and dispatched, the delivery timeframe will depend on the destination, the carrier’s network, and any circumstances affecting their service.
While we will make every reasonable effort to ensure your order is delivered promptly, we cannot guarantee specific delivery dates, and we are not responsible for delays caused by third-party providers or events beyond our reasonable control.
7. Print Quality, Colour and Finishes
We take great care to produce your prints to a professional standard. However, some natural variations should be expected:
- Colour variance: Minor differences between what you see on your screen and the final print are normal due to differences in devices, calibration and print processes. These small differences are not considered defects.
- Margins and centring: Paper and frames may shift slightly during production, leading to small variances in borders or alignment. This is part of the normal production tolerance.
- Materials: Acrylic glazing is used instead of glass to provide durability, shatter resistance and lighter weight.
If there is a genuine production fault or damage, this will be treated as a defect and handled under clause 10.
8. Shipping and Delivery
We ship Australia-wide using Australia Post and other major carriers engaged by our production partner. We ship International orders, unframed only.
All deliveries require a signature on delivery. We do not authorise goods to be left unattended at the delivery address (including at the front door, or in a designated “safe place”). This policy is in place to reduce the risk of loss, theft, or damage to your order. If you are not home at the time of delivery, the carrier will follow its standard procedure, for example, leaving a collection card so the item can be collected from a nearby post office or depot, or arranging re-delivery.
Delivery time frames provided on our website are estimates only. Actual delivery times may vary depending on the carrier’s network, the destination, and any delays caused by third-party providers or events outside our reasonable control. We are not liable for such delays, but we will provide tracking details (where available) so you can monitor your delivery.
9. No Change-of-Mind Returns
Because all of our products, whether framed or unframed, are made to order, we do not accept returns or provide refunds if you simply change your mind or select the wrong item. Please ensure you carefully review your order details, including size and frame options, before placing your purchase.
This policy does not limit or exclude your rights under the ACL. If your product is faulty, damaged, or not as described, you will still be entitled to a remedy under clause 10.
10. Faulty, Damaged or Incorrect Items
All products come with guarantees that cannot be excluded under the ACL. If your order is faulty, damaged or not what you ordered, you are entitled to a remedy which may be a repair, replacement or refund depending on the circumstances.
To report an issue, please email contact@clawandcaneprints.com.au within 48 hours of delivery with your order number, a description of the problem, and clear photos of the item and packaging. Please keep the packaging until we confirm next steps.
If the problem is confirmed, we will arrange a suitable remedy. If a return is required to assess the issue, we will cover reasonable return shipping costs for valid claims.
11. Intellectual Property
All images, content and designs on the Site are owned by us or our licensors. Purchasing a All photographs, images, content and designs displayed on the Site are the exclusive property of Claw and Cane Prints (or our licensors, where applicable). We retain all intellectual property rights in our images, including copyright. Purchasing a print does not transfer or assign any ownership of intellectual property to you.
When you purchase a print, you are granted a limited licence to display the physical item for personal use only.
You must not reproduce, digitise, resell, distribute, license, or otherwise exploit our images in any form without our prior written consent. In particular, our images may not be:
- used in logos, trademarks, merchandise or other commercial applications;
- uploaded or distributed digitally, including on websites or social media without permission; or
- incorporated into artificial intelligence training datasets or similar technologies.
12. Complaints and Dispute Resolution
If you have a complaint, please email contact@clawandcaneprints.com.au using the subject line “Complaints and Disputes”.
We will acknowledge your email within 2 business days and work with you to resolve the issue in good faith.
13. Changes to These Terms
We may update these Terms by posting a new version on the Site. Updates will apply to orders placed after the new version takes effect.
14. Governing Law
These Terms are governed by the laws of Queensland, Australia. By placing an order, you agree to submit to the jurisdiction of the courts of Queensland.
